Famous actress losses battle to move child overseas

Issues involving children are among the most difficult in family law. Child custody can include everything from parenting time and visitation rights, to international abduction matters. Each of these issues has its own complications and each can comes with an emotional toll. The following is a scenario that arises when one parent wants to relocate. Minnesota couples might learn a thing or two from the following case.

This particular dispute involves an ongoing battle between actress Halley Barry and her ex- boyfriend of five years. Barry and her ex have a four-year-old daughter that has been at the center of the couple's ongoing dispute for years. Following the couple's initial split in 2010, they reached an agreement over custody. But, the couple soon thereafter began disputing the best interests of the child once again, a battle that continues to rage until the present.

The current issue that is in dispute is Barry's desire to move overseas with her new fiancé. Barry requested the move earlier this year, but her ex-boyfriend, and the father of the young girl, objected to the movie star's request for relocation, asserting his parental rights. The court, at least momentarily, has sided with Barry's ex-boyfriend denying the actress's request to move. The movie star may decide to appeal the judge's decision in the matter.

Every parent has parental rights. If there are concerns that a custodial parent's decision to relocate might compromise the parental rights of the other parent, whether that parent has been awarded joint custody or visitation rights, it is possible to seek court intervention. It is important, however, to act promptly, particularly if a parent is looking to relocate overseas. It can be difficult, but not impossible, to enforce custody agreements in foreign countries.
